These Terms of Service ("Terms") govern your access to and use of the BizGrow Studio platform, website, and related services (collectively, the "Platform"). By creating an account or using the Platform, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using the software platform provided by BizGrow Studio, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform. You must be at least 18 years old and legally capable of forming a binding contract to use this Platform.
2. Platform Services & Provisioning
BizGrow Studio provides a cloud-based software-as-a-service (SaaS) platform designed for local businesses to automate lead capture, scheduling, reputation management, and communication workflows.
- Upon subscription, you are granted a non-exclusive, non-transferable license to access your dedicated software workspace.
- The platform provisions automatically. We do not provide manual agency services, bespoke web development, or subjective "done-for-you" consulting.
- BizGrow Studio integrates with third-party platforms (e.g., Google, Facebook, Stripe). We are not responsible for the availability, functionality, or policies of these third-party services.
3. Billing, Subscriptions & Fees
By subscribing to a paid module, you authorize BizGrow Studio to charge your selected payment method on a recurring monthly basis.
Workspace Provisioning Fee: A one-time Workspace Provisioning & Carrier Registration Fee of $299 applies to all new accounts. This covers third-party A2P 10DLC network registration costs and automated infrastructure deployment.
- All monthly subscription fees are billed in advance.
- Additional Module Infrastructure Allocation Fees of $97 apply to any modules added after initial workspace deployment.
- Failed payments may result in immediate suspension of automated workflows and platform access until the account is brought current.
4. Acceptable Use Policy
You agree not to use the Platform to:
- Violate any local, state, national, or international law.
- Send unsolicited promotional messages, spam, or misleading communications.
- Transmit malicious code, viruses, or harmful data.
- Attempt to reverse-engineer, decompile, or hack the Platform's infrastructure.
5. SMS & Email Compliance (TCPA/10DLC/Toll-Free)
BizGrow Studio provides the software infrastructure to send SMS and email communications; however, you are solely responsible for the content and legality of your messaging.
- You must strictly adhere to the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.
- You guarantee that you have obtained explicit, legally valid consent (opt-in) from every contact before initiating automated SMS or email sequences.
- Your account will be subject to mandatory A2P 10DLC or Toll-Free number registration for carrier network compliance. Failure to comply with carrier guidelines may result in message blocking or account suspension by the telecom networks.
- No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
- By providing your phone number and submitting any form on our platform or website, you consent to receive SMS text messages from BizGrow Studio. Message frequency may vary. Message and data rates may apply.
- You may opt out of receiving SMS messages at any time by replying STOP to any message. For assistance, reply HELP or contact us at support@bizgrowstudio.com.
- Carrier networks are not liable for delayed or undelivered messages. Consent to receive SMS is not a condition of purchase.
Opt-In Disclosure: By submitting your phone number through any of our web forms, you expressly consent to receive automated SMS messages from BizGrow Studio related to your inquiry or service. This consent is not required to purchase goods or services.
6. Account Cancellation
You may cancel your month-to-month subscription at any time via your customer portal or by contacting support. Cancellations take effect at the end of your current billing cycle. BizGrow Studio does not offer prorated refunds for mid-cycle cancellations. We reserve the right to terminate or suspend your account immediately for violations of these Terms.
7. Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. BizGrow Studio makes no warranties, express or implied, regarding the platform's fitness for a particular purpose.
- BizGrow Studio does not guarantee specific business outcomes, increased revenue, or a specific volume of leads or reviews.
- In no event shall BizGrow Studio be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Platform.
